EU Based DPO, or Non-EU Based DPO? That Is the Question!

By Stuart Cleary10 December 20252 min read

Under the EU GDPR, organisations required to appoint a Data Protection Officer (DPO) often ask: does the DPO have to be located in the EU?

The short answer: no. The GDPR does not explicitly require an EU-based DPO. What it does require is that the DPO is easily accessible to both data subjects and supervisory authorities, and can effectively carry out their tasks.

✅ This means that, in theory, your DPO could sit in New York, London, or anywhere else in the world.

But here's why many organisations still prefer an EU-based DPO:

    • Regulator accessibility — EU supervisory authorities are more comfortable engaging with a DPO based within the EU.
    • Time zones & responsiveness — data subjects and regulators often expect quick turnaround. Being in the same region helps.
    • Language & cultural alignment — a DPO embedded in the EU is more likely to understand local practices and legal nuances.
    • Reduced risk perception — having an EU-based DPO signals stronger commitment to GDPR compliance.

Important distinction: This is different from the EU Representative requirement under Article 27 (which must be in the EU if you have no EU presence). But for the DPO role, "location" can make the difference between simply complying and truly being effective.

    Our Recommendation

👉 Our take: while a non-EU DPO may be legally permissible, an EU-based DPO is often the smarter choice for practical, operational, and reputational reasons.

The effectiveness of your DPO depends not just on their expertise, but also on their ability to:

    • Respond quickly to supervisory authority inquiries
    • Understand local data protection practices
    • Communicate effectively across time zones
    • Build trust with stakeholders

    Key Considerations for Your Decision

    EU-based DPO Advantages

    • Direct regulator engagement
    • Same time zone operations
    • Local legal expertise
    • Enhanced credibility

    Non-EU DPO Considerations

    • May face communication delays
    • Potential accessibility challenges
    • Need for stronger documentation
    • Additional coordination requirements

What do you think — would you trust a DPO outside the EU to effectively represent your company's GDPR posture?
